With Covid-19 and the recreation centers at limited capacity, why do homeowners not get a discount on their dues?

Highlands Ranch Community Association has received a few inquiries as to whether it will provide members with refunds or offsets due to the State of Colorado’s decision to limit capacity and require masks while using the recreational facilities during the COVID-19 pandemic (defined as such by the World Health Organization). These restrictions are put in place to help society “flatten the curve” of new virus cases, protect community members, and decrease pressure on medical infrastructure.

HRCA cannot offer refunds or offsets per our legally binding governing documents. Section 8.40 of the Community Declaration provides,

“All Assessments shall be payable in the amounts specified in the levy thereof and no offsets or reduction thereof shall be permitted for any reason including, without limitation, any claim that the Community Association or the Board of Directors is not properly exercising its duties and powers under this Community Declaration.”

Providing any refunds or offset in this circumstance will harm the community further both today and in the future. HRCA was created not just to administer recreational facilities, but to further and foster the entire community’s health, safety, and welfare.
